Terms and Conditions Campus Forum GmbH

Area of Application

The following general terms and conditions govern the contractual relationship between participants in continuing education events such as seminars, conferences and conventions and Campus Forum GmbH as well as the ordering of digital products for the purpose of continuing education.
It also governs all contractual relationships between Campus Forum GmbH and its clients for any event services (full service as well as individual service) and other activities assumed by Campus Forum GmbH as well as for related services. It also governs any other agreed business relationships for the purpose of event exhibition and or partnering and sponsoring activities in the context of further education events.

I. Participation in further education events as participant or for the purpose of exhibition / sponsoring / partner management / ordering of digital products

Conclusion of Contract / Registration

Unless otherwise agreed in writing, offers made by Campus Forum GmbH are non-binding.

Booking to attend a training event / ordering a digital product / booking an exhibition stand or sponsorship package

The contract with the client is concluded by our written reconfirmation of the order submitted to us or the order placed in the webshop. Client and Campus Forum GmbH are contractual partners.

Registrations for continuing education events and bookings for exhibition stands and sponsorship packages can be made online, by e-mail, post, fax or by telephone (reservation only). Registration only becomes legally binding upon written confirmation by Campus Forum GmbH (electronically or by post) after prior registration. Each legally binding registration is based on these general terms and conditions.

If the event is a presence event, the following applies: The exact stand area allocation will be made by the organizer at a later date.
The allocated stand space may be adapted in front and depth to the local building regulations. Stand space will be allocated on the basis of the chronological order of registrations. Any transfer, even partial, of the rights arising from the admission to third parties requires the written approval of the organizer. The organizer is entitled to change the location and size of a stand area, even at short notice, if this is necessary due to legal or official regulations.

Ordering digital products

Orders for digital products (video and audio content, e-learnings, etc.) can be placed via the Campus Forum GmbH webshop. The order becomes legally binding only upon written confirmation by Campus Forum GmbH (electronically or by mail) after prior registration. Every legally binding registration is based on these General Terms and Conditions.

Termination of contract / cancellation

When booking to attend a training event

Participants in scheduled continuing education events in live format or in presence are entitled to a right of withdrawal. The revocation period is 14 days and begins with receipt of the written registration (online, e-mail, mail, fax). A revocation does not require any justification. The timely dispatch of the written revocation is sufficient to meet the deadline. The right of revocation expires when the event begins with the presence of the participant. Irrespective of the right of withdrawal, participants have the right to name a substitute person to take their place at the event. Once the right of withdrawal has expired, it is no longer possible to withdraw from the binding registration and the full participation fee will be charged. If the withdrawal is made up to one week (7 calendar days) before the start of the event, the participation fee will be reduced to 100,00 euros.

Campus Forum GmbH reserves the right to cancel events. Participants will be informed immediately (by telephone and in writing). Campus Forum GmbH will, as far as possible, provide alternative offers at other dates or locations. If the participants agree to this, they will be rebooked free of charge. In case of non-agreement, participants will receive a full refund of the fees paid. Further claims are excluded.

A claim for reimbursement of travel and accommodation expenses as well as loss of working hours is excluded. Campus Forum GmbH reserves the right to make changes to the organization, staffing or schedule of an event that do not have a significant impact on the overall character of the event.

When booking an exhibition stand or sponsorship package

Withdrawal of the Partner/Sponsor/Exhibitor from this contract is only possible by written notice of termination. If the Partner/Sponsor/Exhibitor withdraws from the contract, it shall continue to be obliged to pay:

  • For cancellation up to 6 months before the event date 20% of the contract amount.
  • For cancellation up to 3 months before the event date 50% of the contract amount.
  • For cancellation up to 6 weeks before the event date 80% of the contract amount.
  • For cancellation from 6 weeks before the event date 100% of the contract amount.

Campus Forum GmbH bears the economic risk of the event and therefore reserves the right to cancel the event at least 6 weeks before the scheduled date. Payments already made to the client will be refunded.

 

When purchasing a digital product

In the case of the purchase of a digital product (e-learning, video and audio files and other content for data retrieval), the right of withdrawal expires at the beginning of the execution of the contract. The purchaser agrees to the waiver of revocation with the order. Digital products are subject to a limited period of use of 12 months from the state of the dial-up or download data. The usage period of 12 months shall generally apply to the purchase of digital products from Campus Forum GmbH, unless there is another written contractual agreement with the buyer. The period of use is specified prior to the conclusion of the purchase agreement and confirmed by the buyer by ordering the product and agreeing to it.

Payments

When booking to attend a training event / ordering a digital product / booking an exhibition stand or sponsorship package

The contract fee is due upon receipt of invoice and payable without deductions by bank transfer. The costs of the payment transaction shall always be borne by the client. In case of non-payment Campus Forum GmbH reserves the right to cancel and pass on the place. In case of default of payment Campus Forum GmbH is entitled to charge default interest in the amount of 5% above the prime rate (§ 247 Abs. 1 BGB) p.a.. The fee includes the services named in the advance notice of the event; regularly not included are, for example, accommodation and travel costs.

In the context of orders via the webshop of Campus Forum GmbH, the options for payment via Paypal, Stripe (credit card, giropay, Sofort Überweisung) and direct bank transfer are also offered. In case of a transaction via Paypal or Stripe, this will be carried out automatically by the payment provider immediately after confirmation of the payment instruction. Certificate of attendance / examination certificates

Participants will receive a certificate of participation from Campus Forum GmbH upon request. When booking continuing education formats that are to be completed with a final examination, participants automatically receive a written certificate of examination success after passing the examination.

Renting Campus Forum GmbH items

The rental items are only provided for the agreed time. Shortages, breakage and damage shall be borne by the client. In the event of loss, the client shall pay damages in the amount of the purchase price. All our deliveries are subject to retention of title. A transfer of ownership shall only take place to the extent provided for in the contractual relationship and only after full settlement of our services owed under current contracts and payment of all our outstanding claims arising from the business relationship with the client.
Upon termination of the contractual relationship, all rooms, items and equipment provided to the client shall be returned in the condition in which they were provided to the client.

Copyrights

The continuing education and event documents and files (print and digital) are protected by copyright. Reproduction, transfer or other use of these documents is only permitted with the express written consent of Campus Forum GmbH.
Campus Forum GmbH owns the copyrights to video and audio recordings produced by Campus Forum GmbH or recorded in the Campus Forum GmbH studio, as well as to recordings of digital events conducted by or with Campus Forum GmbH and recorded by the latter. Further agreements and possible transfers of rights of use to third parties are governed by project-related license agreements.

Liability

The events are carefully prepared and conducted by qualified authors and speakers. Campus Forum GmbH assumes no liability for the timeliness, accuracy and completeness with regard to the conference documents and the implementation of the event. Campus Forum GmbH shall only be liable for property damage and financial losses for which it is responsible, irrespective of the legal grounds, to the extent that it is guilty of intent and/or gross negligence, provided that no mandatory legal provisions exist to the contrary.
Campus Forum GmbH shall be liable for damages incurred during an event, except in cases of intent and gross negligence, only in the event of a breach of essential contractual obligations, the breach of which may jeopardize the overall purpose of the contract. Any compensation for damages shall be limited to the respective coverage amount of the Campus Forum GmbH’s business liability insurance. Campus Forum GmbH shall not be liable for such damages – especially in the case of outdoor events – which have occurred due to extraordinary natural events, force majeure or terror.
If an event requires special safety precautions or if the circumstances (venue, individual program items) necessitate the conclusion of insurance policies, Campus Forum GmbH shall be entitled to conclude corresponding agreements on behalf and for the account of the Principal. Any exhibition, conference or other items carried along shall be at the risk of the Principal in the event rooms, unless the lessor is liable to pay compensation. For this reason, Campus Forum GmbH shall not assume any obligation to guard or store such items, in particular not after the end of an event. The client alone is responsible for the insurance of objects brought along.

Data storage and use

Campus Forum GmbH treats personal data confidentially and will only use it in accordance with data protection regulations. Personal data will be stored and used for organizational purposes of Campus Forum GmbH and for future information about offers of Campus Forum GmbH. Every participant has the right to revoke his/her consent to the storage and use of his/her data and to object to the future unsolicited sending of information material.

Other

These General Terms and Conditions and the entire legal relationship between the contracting parties shall be governed by the laws of the Federal Republic of Germany. Amendments and/or supplements to these agreements must be made in writing, which cannot be waived verbally. Verbal collateral agreements have not been made. Should individual provisions of these General Terms and Conditions of Business be or become invalid or void or contain a loophole, this shall not affect the remaining provisions. The contracting parties undertake to replace the invalid or void provisions with a permissible provision that comes as close as possible to the economic purpose of the intended provision. This also applies to the filling of a gap in the contract.

II. In the event that Campus Forum GmbH is commissioned for the purpose of event organization and for the purpose of renting event space

Conclusion of contract

Unless otherwise agreed in writing, offers made by Campus Forum GmbH are non-binding.

The contract with the client shall be concluded by mutual signing of the contract of assignment or alternatively by written confirmation by the client of the offer received from Campus Forum GmbH.

Preparation of contracts / contracts with third parties

Contracts with third parties which are agreed upon and necessary for the implementation of an event or the creation of a digital product shall be concluded by Campus Forum GmbH on behalf and in the name of the Principal, for which Campus Forum GmbH shall be authorized within the scope of the concluded contract. Upon request of Campus Forum GmbH, the Principal shall grant Campus Forum GmbH a corresponding written power of attorney. Any deviating provisions must be made in writing. The Principal warrants that the event Campus Forum GmbH is commissioned to organize will not infringe the rights of third parties, in particular that it will not violate any legal regulations of any kind.

Termination of contract / cancellation

Clients/contractual partners for the purpose of event organization or partial services as well as rental parties of event spaces are entitled to a right of revocation. The revocation period is 14 days and begins with receipt of the written registration (online, e-mail, mail, fax). A revocation does not require any justification. The timely dispatch of the written revocation is sufficient to meet the deadline.

Campus Forum GmbH is entitled to withdraw from the contract if circumstances for which Campus Forum GmbH is not responsible make it impossible to fulfill the contract. The same applies if events and premises have been booked with false information about essential facts, e.g. the purpose of the event, in particular if, contrary to the assurance given, the rights of third parties are impaired by the execution of the event or legal regulations are violated.
Likewise, Campus Forum GmbH shall be entitled to cancel the contract if the prerequisites or information required for the fulfillment of the contract have not been provided by the client correctly, completely or in a timely manner within the agreed time and project schedule, and thus the proper and/or timely performance of services by Campus Forum GmbH is rendered impossible. In such cases, the regulations agreed upon for the cancellation as well as for the costs of third parties shall generally apply. Campus Forum GmbH expressly reserves the right to assert a claim for damages in excess thereof.

The client is granted the right to cancel the order or the room booking – in whole or in part. The cancellation must be made in writing. After cancellation Campus Forum GmbH may demand an appropriate fee. Unless otherwise agreed in writing, the amount of the cancellation fee shall be calculated as follows:

  • From order placement to 60 days 30% of the order amount / rental price,
  • from 59 to 30 days 50% of the order amount / rental price,
  • from 29 to 15 days 70 % of the order amount / rental price
  • from 14 to 01 day 90 % of the order amount / rental price.

At the time of cancellation by the client, expenses already incurred due to the order that exceed the percentage scale shall be borne additionally by the client. This also includes all costs incurred by third parties, e.g. due to material and catering orders already placed and others.
If Campus Forum GmbH and the client agree on a minimum number of participants for the registration of participants, Campus Forum GmbH reserves the right to invoice the agreed minimum number of participants if this number is not reached.
If the client, without consultation with Campus Forum GmbH, changes decisive conditions of the order which influence the organizational or administrative effort at Campus Forum GmbH (e.g. change of venue, date, time, procedure of participant handling, time deadlines and task areas defined in the time and project plan, budget framework), Campus Forum GmbH is entitled to invoice the additional costs incurred by it in accordance with the fee amounts agreed upon for the event.

Payments

Invoices of Campus Forum GmbH shall be payable without deduction within 14 days from receipt of the invoice. In case of default of payment by the Principal(s), Campus Forum GmbH shall be entitled to charge default interest in accordance with the statutory provisions. In case of default of payment Campus Forum GmbH shall be entitled to charge default interest in the amount of 5% above the prime rate (§ 247 Abs. 1 BGB) per annum.
Campus Forum GmbH is entitled to demand a reasonable advance payment on the expected invoice amount at any time. Advance payments made will be offset against the final invoice. If the advance payment amount charged by Campus Forum GmbH is not made within the agreed period, Campus Forum GmbH shall be entitled to withdraw from the agreements made with the client. In this case Campus Forum GmbH may claim cancellation costs according to these general terms and conditions.

Renting Campus Forum GmbH items

The rental items are only provided for the agreed time. Shortages, breakage and damage shall be borne by the client. In the event of loss, the client shall pay damages in the amount of the purchase price. All our deliveries are subject to retention of title. A transfer of ownership shall only take place to the extent provided for in the contractual relationship and only after full settlement of our services owed under current contracts and payment of all our outstanding claims arising from the business relationship with the client.
Upon termination of the contractual relationship, all rooms, objects and facilities made available to the Client shall be returned in the condition in which they were provided to the Client.

Copyrights

The continuing education and event documents and files (print and digital) are protected by copyright. Reproduction, distribution or other use of these documents is only permitted with the express written consent of Campus Forum GmbH.
Campus Forum GmbH owns the copyrights to video and audio recordings produced by Campus Forum GmbH or recorded in the studio of Campus Forum GmbH as well as to recordings of digital events conducted by or with Campus Forum GmbH and recorded by Campus Forum GmbH. Further agreements and possible transfers of rights of use to third parties are governed by project-related license agreements.

Liability of the client

The client is liable for any damage, loss or infringement of third party rights caused by him, his guests, his employees, vicarious agents or other third parties commissioned by him during the preparation and execution of the order. The client is responsible for providing appropriate insurance coverage at his own expense.

Campus Forum GmbH treats personal data confidentially and will only use it in accordance with data protection regulations. Personal data will be stored and used for organizational purposes of Campus Forum GmbH and for future information about offers of Campus Forum GmbH.
